Allahabad High Court Pulls Up Petitioner, Judge Recuses from Rahul Gandhi Citizenship Case: The Allahabad High Court on Monday harshly criticised an BJP employee who made a request for the filing of an FIR in relation to Allahabad High Court Pulls Up Petitioner, Judge Recuses from Rahul Gandhi Citizenship Case based on allegations of having British citizenship.
The court expressed grave concerns about posts on social media made by the petitioner. The court also stated that the judiciary was “maligned” through public commentary that questioned its operation.
Justice Subhash Vidyarthi of the Lucknow Bench took strong exception to the petitioner’s remarks on social media or in newspapers, suggesting the possibility of bias as well as “foul play” in the proceeding.
Judge Dismisses Hearing of Judge
After those developments Justice Vidyarthi recused himself from the matter. He said he was disappointed in having to take up the case and said that petitioner seemed use the legal process to gain “political mileage.”
The judge was skeptical of the petitioner’s behavior, saying that making accusations against the judiciary in public venues undermines its credibility and draws the judiciary into political discussions.

Court Flags Attempt to Influence Proceedings
The court also noted the fact that the petitioner sought the opinion of the public on social media regarding what should happen to the trial and whether it ought to go on with the judge. Furthermore, he had contacted to the chief justice of India in a manner that which the court considered to be attempts to discredit the process of judicial review.
Additionally that both the government advocate as well as the deputy Solicitor General for India were of the opinion that petitioner’s online postings were indecent and unjustifiable.
Petitioner’s Defense Rejected

In reply the petitioner claimed that his comments were not directed at the court, but rather at the people who were allegedly trying to pressure him to withdraw the lawsuit. He also argued that he previously praised the court’s previous decision to order an FIR to Rahul Gandhi.
The court, however, rejected the argument, saying that the judiciary doesn’t require public praise and any complaints should be dealt with via legal channels like an appeal.

Background: FIR Order Put on Hold
The recusal came shortly after the bench paused its earlier oral order on April 17, which called for the filing for an FIR in the case of Rahul Gandhi. In a written decision posted to the internet on April 18, it suspended this order, stating that Gandhi must be given the opportunity to be heard prior to any decision is taken.
Allegations Over Citizenship
The petitioner claimed to have emails and documents of the British government that allegedly prove Rahul Gandhi has British citizenship. If proved, this claim could limit his ability to participate in elections or stay as a Parliamentary Member.
