A growing level of discontent in lawmakers over the way discipline actions are dealt with may make it harder to get rid of House members convicted of serious misconduct.

Republican Rep. Nancy Mace has said she is planning to introduce a privilege motion to get a vote on the expulsion of Cory Mills. Mills is accused of domestic violence, financial mismanagement and making false claims about military honours. Mills has resisted any allegations and said the company will not resign.

Despite the seriousness of the accusations, some Democrats are hesitant to take the action even as Mills is being investigated through the House Ethics Committee.

Present situation:

Cherfilus-McCormick quit just as she was due to report that the Ethics Committee was expected to issue penalties against her. The panel previously found her guilty of various violations, which included allegedly redirecting $5 million in illegally allotted COVID-19 funds towards her own campaign. She has denied the allegations and claimed that the process was unfair, arguing that she couldn’t completely defend herself when facing the possibility of a criminal trial.

While a majority of Democrats were willing to vote for her removal Members from the Congressional Black Caucus were among her most vocal supporters until her resignation.

What lawmakers have to say:

Rep. Hank Johnson voiced concern over the possibility that Congress might be overreaching itself by removing members prior to convictions, and he said he regrets the decision to expel Santos even though an Ethics report was issued.

Rep. Jonathan Jackson, who voted against Santos his expulsion, stated that he’s spoken to colleagues who are also in the same boat. Rep. Emanuel Cleaver echoed this sentiment, highlighting the importance of ensuring the right to due process.

The past:

Santos was kicked out in 2023 due to the publication of an Ethics Committee report accusing him of a wide range of financial fraud. Santos later admitted to identity theft and wire fraud. theft, was given an 87-month sentence, and then was released in the hands of Donald Trump.

There are many Democrats are hesitant about the removal of Mills prior to the Ethics Committee completes its work. Rep. Sydney Kamlager Dove was skeptical about the rationale of lawmakers intervening before legal procedures are completed, indicating that the motives of political parties could be involved.

Some, such as Rep. Greg Meeks, insist that Congress should apply the same standards across parties which suggests that the issue of the due process versus accountability is far from being settled.
